The present petition is for grant of anticipatory bail to the petitioner in case FIR No.35 dated 15.05.2023, under Sections 379 and 411 (added later on) of IPC, registered at Police Station Jhunir, District Mansa (Punjab).

Vide order dated 29.12.2023, a Coordinate Bench of this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.

Learned State counsel, on instructions from ASI Daler Singh, submits that the petitioner has joined the investigation and his custodial interrogation is no longer required.

In view of above, the petition is allowed. The order dated 29.12.2023, granting interim anticipatory bail to the petitioner, is made SANDEEP SETHI 2024.02.24 01:22 I attest to the accuracy and integrity of this Order/Judgment
-22024:PHHC:024109 CRM-M-65504-2023 absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.

However, this order shall not be construed as a final expression of opinion on the merits of the case as well as parity qua any other co-accused.

It is made clear that, in case, the petitioner is found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
