MANJARI NEHRU KAUL , J. (ORAL) Petitioner is seeking quashing of order dated 14.10.2015 (Annexure P-2) passed by learned Additional Chief Judicial Magistrate, Kapurthala, whereby the petitioner had been declared as proclaimed offender in case FIR No.45 dated 27.04.2013 under Sections 420, 457, 468, 471, 120-B of the IPC registered at Police Station Sadar, Kapurthala.

Learned counsel for the petitioner at the outset submits that the petitioner is ready and willing to appear and surrender before the trial Court. Hence, in the aforementioned facts and circumstances, petitioner be protected till his appearance before the trial Court and directions be given to the trial Court that his bail application, which he would be filing on his surrender, be decided expeditiously. 3.

In compliance of order dated 09.12.2024, photocopy of the air tickets of the petitioner qua his intended travel to India has been filed in Court, which is taken on record subject to just exceptions. On asking of the Court, Mr. H.S. Deol, Senior Deputy Advocate General, Punjab, accepts notice on behalf of the respondent. 6.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of with directions to the petitioner to appear and surrender before the trial Court within seven days w.e.f. 20.01.2025 to 27.01.2025. Till then, no coercive steps be taken against the petitioner. This shall, however, be subject to payment of costs in the sum of `20,000/- to be deposited with the District Legal Services Authority, Kapurthala.

It is made clear that in case, the petitioner fails to surrender before the trial Court within the stipulated perioid, this order shall be of no avail to him thereafter. In case, on appearance and surrender, the petitioner moves an application for bail, the trial Court shall make earnest efforts to decide it expeditiously, in accordance with law.
