Learned counsel for the petitioner inter alia submits that it is a case of version and cross version. It has been submitted that FIR No.142 dated 27.05.2023 had also been registered under Sections 148/149/307/323 /379-B/427/506 IPC and Section 25 of the Arms Act, 1959 on a complaint submitted by the wife of the present petitioner. The same was subsequently ordered to be cancelled by the police. This action has been assailed by the petitioner by way of CRM-M-59536-2023 and the matter is pending for 30.01.2024 (Annexure P-7).

Learned counsel further submits that the main accused in the present FIR who is alleged to have fired a shot namely Aamin has been arrested and is in custody. It has been submitted that co-accused Ashu @ Ash Mohammad approached this Court seeking pre-arrest bail. The said petition bearing CRM-M-63916-2023 is pending before this Court and is listed for 01.02.2024.
