This petition has been filed under Section 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996, for extension of time-period for making the Arbitral Award.

Counsel for the petitioner states that by order dated 16.12.2022, Annexure P-1, passed in ARB-183-2022, this Court referred the dispute for adjudication to a former Judge of Supreme Court. He submits that the arbitration proceedings could not conclude within the statutory time frame. In the meanwhile, another dispute between the parties has been referred to the learned Arbitrator and both the matters are being taken up together. It is his assertion that the pleadings in the second case are not complete and in the present case, time-period is expiring in February, 2025 and by order passed on 03.06.2024, learned Arbitral Tribunal directed the petitioner to file an application for extension.

Mr. Sumit Jain, Advocate, with Mr. Abhishek Arora, Advocate, have put in appearance and accept notice on behalf of respondent No.1. They have filed Memorandum of Appearance, which is taken on record. Mr. Jain submits he has not any objection, if time-period is extended for a period of six months from the expiry of the present extension.

Accordingly, period for conclusion of arbitral proceedings is extended by another period of six months beyond 28.02.2025. 6.

Petition is disposed of.
