As observed in the previous order, none had made appearance on behalf of the respondent. Even today, none has made appearance on behalf of respondent. As such, respondent is proceeded against ex-parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 (1) (ia) (ib) of the Hindu Marriage Act i.e. HMA-738-2025, titled 'Harmandeep Singh Vs. Manjeet Kaur', filed by the respondent-husband, pending in the Family Court, Amritsar and she seeks transfer of the same to the Court of competent jurisdiction at Gurdaspur.

TA-1357-2025 -2It is submitted by counsel for the applicant that marriage between the parties to the lis had taken place on 26.11.2023 and unfortunately, matrimonial dispute arose between the parties and they are residing separte. From the estranged marriage, one daughter was born, who is 11⁄2 years old and is presently in the care and custody of the applicant. The applicant is not having any source of earning and she along with her daughter, is dependent upon her parental family. She has filed petition under Sections 9(B), 12, 19(F), 19(8), 20(d), 20, 23 and 37(2) (c) of the Protection of Women from Domestic Violence Act, which is pending in the Courts at Gurdaspur and the respondent has already joined the proceedings. The distance between the two places is stated to be 90 kms.

(1) (ia) (ib) of the Hindu Marriage Act i.e. HMA-738-2025, titled 'Harmandeep Singh Vs. Manjeet Kaur', filed by the respondent-husband, stands transferred from the Family Court, Amritsar, to the Court of competent jurisdiction at Gurdaspur. The requisite record of the aforesaid case be sent by the Family Court, Amritsar, to the District and Sessions Judge, Gurdaspur.

Learned District and Sessions Judge, Gurdaspur, shall assign the said petition to the Family Court, Gurdaspur. Even, the parties are
