Petitioner has filed instant petition under Section 528 of BNSS, 2023 for issuing directions to respondents to get NCCT of head of petitioner conducted from respondent No.5 involved in FIR No.193 dated 05.10.2024 under Sections 103,109, 125, 190, 191 (3) of BNS, 2023 and Sections 25 and 27 of Arms Act, 1959 registered at Police Station Lopoke, District Amritsar (P-1) in pursuance of directions issued by learned Judicial Magistrate 1st Class, Ajnala vide order dated 29.10.2024 (P-4). 2.

It is pointed out that FIR No.193 dated 05.10.2024 was registered on the statement of Balwinder Singh whereas in cross-version DDR No.25 dated 08.10.2024 (Annexure P-2) was registered on the statement of Jagroop Singh - present petitioner. His MLR was prepared and he was recommended for NCCT of Head. Regarding this, application SANDEEP KUMAR 2024.12.05 13:46 I attest to the accuracy and integrity of this document

  was filed before the Illaqa Magistrate and order dated 29.10.2024 was passed which is Annexure P-4. Despite this, Investigation Agency has not taken any step in this regard.

On asking of this Court, Mr. Kewal Singh, Addl. A.G. Punjab accepts notice on behalf of State.

I have gone through the record. Perusal of order dated 29.10.2024 (Annexure P-4) indicates that specific order is already passed by learned Judicial Magistrate 1st Class, Ajnala. Therefore, no further direction is required from this Court. Petitioner is directed to file appropriate application before Illaqa Magistrate in case of non-compliance of order dated 29.10.2024 and on filing of such application for noncompliance, the said Court will take appropriate steps within one week from filing of application.

With this direction, present petition is disposed of. 7.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
