(Oral) At this stage, the respondent as well as his counsel, have given an undertaking that that the petition under Section 13 of Hindu Marriage Act, shall be withdrawn by him, by way of filing of an application, before learned trial Court, within a period of ten days from today onwards. In view of the undertaking, so given, the counsel for the applicant submits that he does not want to pursue with the transfer application and the same be dismissed as withdrawn. Ordered accordingly.

However, in view of the undertaking given, it is hereby directed to file an application for withdrawal of the petition under Section 13 of Hindu marriage, within a period of ten days from today onwards and upon filing of such application, the trial Court shall pass an appropriate order, with regard to the submission qua withdrawal as per the undertaking by the respondent as well as his counsel, today.
