Criminal Misc. Application bearing No.CRM-W-1583-2025, under Section 528 of BNSS, has been filed seeking preponement of the date of hearing in the main case, i.e. CRWP-11350-2025, which is listed for 12.11.2025.

Counsel for the applicants/petitioners contends that the main petition, i.e. CRWP-11350-2025, was originally instituted seeking protection for both the petitioners, who were residing together in a live-in relationship. However, subsequent to the filing of the said petition, both the petitioners have solemnized their marriage. In view of this development, learned counsel prays that permission be granted to withdraw the main petition, CRWP-11350-2025, so as to enable the petitioners to file a fresh protection petition based on marriage. Considering the submissions advanced by counsel for the applicants/petitioners, date of hearing in the main case is preponed from 12.11.2025 to today itself, i.e., 04.11.2025, and the same is taken on board for disposal.

In view of the statement made by counsel for the petitioners, present petition stands dismissed as withdrawn, with liberty to file a fresh protection petition based upon marriage performed by both the petitioners.

As a necessary corollary, the main petition i.e. CRWP11350-2025 is dismissed as withdrawn, with the liberty as sought and recorded here above.
