The prayer in the present petition under Section 528 of BNSS, 2023 is for issuance of directions to official respondents to conduct a fair and proper investigation in FIR No.0485 dated 16.10.2023 (Annexure P-1) registered under Sections 186, 283, 341, 342 and 149 IPC at Police Station City Barnala, District Barnala, Punjab. 2.
The learned counsel for the petitioner contends that a free and fair investigation has not been conducted in the instant case. Only 03 persons have been nominated as accused though there are as many as 150 persons who are liable. Therefore, directions be issued in terms of the prayer made.

The learned counsel for the State, on the other hand, contends that after investigation a report under Section 173 (2) Cr.P.C. (Section 193 BNSS) stands presented against 03 accused. In view of the respective contentions of both sides, the present petition is disposed of with liberty to the petitioner to avail his remedies in accordance with law as regards the remaining accused, if any. 5.
