With reference to our order dated 11.12.2024, learned counsel for the respondent submits that although the bids submitted by the petitioner were entertained and processed by the respondent but upon evaluating the price bid, the petitioner is adjudged H-II, thus the issue that arises for consideration is rendered academic. Accordingly, it is submitted that that the petition be disposed of as having been rendered infructuous but the issue raised in the petition be kept open to be examined in an appropriate proceeding. Ordered accordingly.
