Criminal Complaint No. 304/2017, under Section 138 of the Negotiable Instruments Act, District Fatehgarh Sahib CNR No. PBFG030058582017 Date of Decision: 03.12.2019 Criminal Appeal No. CRA-6-2021, Additional Sessions Judge, Fatehgarh Sahib CNR No. PBFG010003532021 Date of Decision: 21.11.2024 1.

Seeking setting aside of impugned orders dated 03.12.2019 and 21.11.2024 passed by JMIC, Fatehgarh Sahib and Additional Sessions Judge, Fatehgarh Sahib respectively, the petitioner has come up before this Court by filing the present revision petition under Section 401 CrPC.

After the conviction by the trial Court which was upheld by the Sessions Court, the convict along with the complainant has settled their matter in mediation. Deed of compromise filed by the parties is already on record. 3.

Once the parties have settled the matter, the objective of Section 138 of Negotiable Instruments Act is recovery of money and penal in nature only for the purpose of recovery of money and now the objective itself has been met, there is no reason for this Court to uphold the conviction.

Given above, based on the compromise and the objective of the statute, the present petition is allowed. Judgment of conviction and order of sentence passed by the trial Court and upheld by the Sessions Court are set aside. Petitioner is acquitted of all the charges. Bail bonds are discharged. It is clarified that the petitioner shall comply with the terms and conditions as agreed by him. All pending application(s), if any, stand closed.
