The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.81 dated 15.06.2020 registered under Sections 323, 324, 326, 341 and 34 of IPC at Police Station Gharinda, Amritsar.

The learned counsel for the petitioner contends that the petitioner-Gursharan Singh has been attributed only a simple injury on the right shoulder of Gursewak Singh with a datar. The injury attracting Section 326 IPC has been attributed to Harjit Singh, on the head of Jaskaran Singh with a datar. Harjit Singh has been granted the concession of regular bail by the Court of Additional Sessions Judge, Amritsar. As the petitioner is in custody since 25.07.2025 but only 03 of the 13 prosecution witnesses have been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

CRM-M-59605-2025 -23. On the other hand, the learned State counsel has filed a reply dated 12.03.2026, which is taken on record. While referring to the said reply, he contends that the petitioner and his co-accused brutally assaulted the injured. Therefore, he is not entitled to the concession of bail. He, however concedes that the petitioner is in custody since 25.07.2025 but only 03 of the 13 prosecution witnesses have been examined so far. 4.
I have heard the learned counsel for the parties. 5.
The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 25.07.2025 but only 03 of the 13 prosecution witnesses have been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required. 6.
Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Gursharan Singh S/o Puran Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.
The petition stands disposed of.
