Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the Pension as well as other benefits of the petitioner, along with interest @ 18% per annum, as he has sought the Voluntary Retirement w.e.f. 05.04.2016.

Learned counsel for the petitioner submits that the petitioner has voluntarily retired from service w.e.f. 05.04.2016 vide order dated 17.09.2018 (Annexure P-1) and the charge-sheet pending against the petitioner has been culminated into passing of the punishment order dated 04.12.2024, whereby his two annual increments have been ordered to be stopped with cumulative effect, however, his retiral dues have not been released. CWP No.33085 of 2024 2), followed by a legal notice dated 23.10.2024 (Annexure P-3), however, neither the same has been replied nor the retiral dues of the petitioner have been released.

Ms. Poonam, Advocate, accepts notice on behalf of respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to consider and decide the legal notice dated 23.10.2024 (Annexure P-3), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order. Necessary benefits, if any, found due to the petitioner shall be released expeditiously preferably within a period of four weeks thereafter.
