For the reasons stated in the application, the same is allowed and amended memo of parties and affidavits of victims are ordered to be taken on record.

Main case:

The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of FIR No.

 185 dated 21.07.2025 under Section 3(1) (a) and offence under Sections 3(1)m, 3(1)r, 3(1) S, 3(1)y, 3(1) za (D) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities Act, 1989) (Amendment 2015) and under Section 127(2) BNS, 2023 were added lateron registered at Police Station Tanda, Hoshiarpur along with all the consequential proceedings arising therefrom on the basis of compromise deed dated 04.10.2025. 2.

Mr. Rishabh Singla, AAG, Punjab accepts notice on behalf of the respondent No.1-State. He states that no other FIR has been registered against the petitioners and they have no known criminal antecedents. 4.

Mr. Ankit Gupta, Advocate accepts notice on behalf of respondent Nos.2 to 4 in the Court today. He has also filed the affidavit of respondent Nos.2 to 4 in the Court and the same is taken on record. He confirms the factum of the compromise having been effected between the parties and states that respondent Nos. 2 to 4 have no objection to the quashing of the FIR in question.

In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 6.

Accordingly, the petition is allowed and FIR No. 185 dated 21.07.2025 under Section 3(1) (a) and offence under Sections 3(1)m, 3(1)r, 3(1) S, 3(1)y, 3(1) za (D) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities Act, 1989) (Amendment 2015) and under Section 127(2) BNS,

 2023 were added lateron registered at Police Station Tanda, Hoshiarpur and all the subsequent proceedings arising therefrom stands quashed qua the petitioners on the basis of compromise subject to payment of Rs. 10,000/- as costs in the Punjab State Legal Services Authority Disaster Relief Fund bearing Account No. 44426937384 IFSC Code SBIN0014656 Branch Name Sector 68 SAS Nagar, Mohali.
