Report dated 08.12.2025 of the learned Additional Sessions Judge, Patiala has been perused.

Relevant facts as emerging from documents on record be noticed hereinbelow:- Petitioner had filed a complaint No.1270/2019 dated 07.04.2018 under Section 138 of the NI Act against the respondents. The said complaint was decided by the learned trial Magistrate in terms of judgment dated 19.04.2023. Respondent No.1 was convicted of offence under Section 138 of the NI Act and was sentenced in the following terms:- Convicted under Section Sentence Imposed 138 of NI Act SI for 18 months and to pay compensation to the complainant equal to the amount of cheque in dispute with interest @ 9% per annum.

Dissatisfied with the quantum of sentence, petitioner filed an appeal No.CRA-250-2023 seeking enhancement of the same. The said appeal is pending before the learned Additional Sessions Judge, Patiala. It further emerges from documents on record that respondent-accused also assailed the judgment of conviction passed against him in CRA No.239 of HAMANT 2025.12.10 17:12 I attest to the accuracy and integrity of this document

CRM-M-60264-2025 2023, which is also pending adjudication.

The only limited prayer of the petitioner-complainant is that the aforesaid appeals be decided by the learned Additional Sessions Judge, Patiala expeditiously in accordance with law. 3.

The present petition is disposed of with a direction to learned First Appellate Court to decide the two aforesaid appeals on or before 30.04.2026.
