RAJESH BHARDWAJ, J.(ORAL) 1.

Instant appeal has been filed against the judgment and order, dated 20.03.2017 passed by learned Judge, Special Court, Sangrur, in case FIR No.199, dated 27.08.2013, under Sections 15, 61, 85 of NDPS Act, registered at Police Station Sadar Dhuri, District Sangrur, vide which the learned Court has ordered for confiscation of oil tanker No.PB-19F-1006 by initiating separate proceedings. Alongwith appeal an application for condonation of delay of 2771 days in filing the appeal has also been filed. 2.

Learned counsel for the applicant/appellant prays for withdrawal of the present appeal as well as the application for condonation of delay with liberty to the appellant to avail the alternative remedies. 3.

Allowed as prayed for.

Both the application as well as appeal are dismissed as withdrawn with liberty aforesaid.
