The present contempt petition has been filed for deliberate and intentional disobedience of order dated 29.05.2024 passed by this Court in CWP-12598-2017.

This Court had passed the following order in CWP-12598-2017, vide its order dated 29.05.2024:- "2.

Though at the time when the writ petitions were filed, the grievance was qua the declaring certain petitioners ineligible for the post in question and selecting the candidates, who were lower in merit than the petitioners but in the intergrum of five years, a lot of facts have come into being including the revised merit list, terminating the services of the candidates who were already appointed in pursuance to the initial merit list

-2and also appointing certain petitioners numbering 114 out of the revised merit list.

Learned counsel for the petitioners submits that there are certain advertised posts out of the 964, which are still lying vacant in the category in which the petitioners are competing and are eligible and coupled with the fact that the petitioners have more marks than the candidates who have already been appointed and working, hence those vacant post out of 964 advertised be given on merit to the petitioners on the basis of revised merit list.

Learned Advocate General, Haryana submits that in case, any post out of the total 964 posts advertised is still lying vacant in the category in which the petitioners are competing, the petitioners will be appointed against the said vacant posts subject to their eligibility for the post in question and merit.

Learned Advocate General, Haryana further submits that only the candidates/petitioners who come within the advertised posts will be offered these and not all the petitioners.

Learned Advocate General, Haryana further submits that all the vacant posts will be identified and against the identified posts out of total 964 posts, the claim of the petitioners will be considered for appointment on the post in question on the basis of their merit keeping in view the category in which they are competing and after ascertaining whether, any post is vacant in the said category or not and if found that the posts are vacant in the category in which the petitioners are competing, the petitioners will be considered for selection and appointment against those posts subject to their eligibility.

Learned counsel for the petitioners submits that keeping in view the statement of learned Advocate General, Haryana, no further grievance of the petitioners survives in the present petitions hence, the present petitions may kindly be disposed of having been not pressed any further but the respondents be time bound to conclude the said exercise so that the petitioners do not suffer any prejudice.

Learned Advocate General Haryana submits that the exercise will be completed within a period of four months of the receipt of copy of this order." 3.

In compliance of the order dated 29.05.2024 passed by this Court in CWP-12598-2017, despite other affidavits, a comprehensive affidavit dated 24.10.2025 of Sh. Himmat Singh, Chairman, Haryana Staff Selection Commission, Panchkula, along with Annexure R-1/1, has been filed on behalf of respondent No.1 before the Registry. The same is taken on record. The relevant portion of the said affidavit is reproduced as under:- "7.

That it is relevant to mention here that on the basis of vacancy position received from indenting power utilities and eligibility status of petitioners, the Commission has duly sent recommendation dated 15.01.2025 to indenting power utilities. The candidature of the candidates who were found ineligible because of not fulfilling requisite essential qualification was not considered for the post in question. After compliance of order dated 29.05.2024 the following seats/posts in different categories remained vacant due to nonavailability of suitable eligible candidates:- UHBVNL- SC-76, BCA-48, BCB-30, ESM-SC-12, ESMBCA-13, ESM-BCB-19, OSP-SC-08, OSP-BCA-05, OSPBCB-04, ОH-03, HH-07. DHBVNL- ESM-BCB-08, OSP-BCB-01, HH-05, VH-05. It is relevant to mention here that the Commission has duly complied with order dated 29.05.

2024 by passing a speaking order thereby deciding the claim of petitioner. So, if the petitioner has any grievance against the speaking order so passed, then in such case, he can avail legal remedy available to him as per law. It is further necessary to mention here that the petitioner has filed present contempt petition for deliberate, willful violation of order dated 29.05.2024, whereas there is no deliberate/willful disobeyance of Hon'ble Court order dated 29.05.2024 on part of deponent and the Commission has duly complied with order dated 29.05.

-415.01.2025 and by passing a required speaking order dated 22.01.2025 in case of present petitioner on account of his ineligibility."

A perusal of the above shows that in compliance of the order dated 29.05.2024 passed by this Court in CWP-12598-2017, speaking order dated 22.01.2025 has been passed by the Secretary, Haryana Staff Selection Commission, Haryana, which is taken on record, vide order dated 22.01.2025.

In view of the above, since order dated 29.05.2024 passed by this Court in CWP-12598-2017, has been complied with, therefore, the present contempt is purged and rule stands discharged. 6.

Needless to say that the petitioner is at liberty to avail remedy as is available to him in accordance with law to challenge the speaking order dated 22.01.2025 passed by the Secretary, Haryana Staff Selection Commission, Haryana.
