(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, i.e. HMA/472/2024, titled 'Gurpreet Singh Vs. Harwinder Kaur', filed by the respondent-husband, pending in the Family Court, Amritsar and she seeks transfer of the same to the Court of competent jurisdiction at Batala. In pursuance of notice issued, the respondent did not make appearance and as such, was proceeded against ex parte, vide order dated 09.02.2026.

Counsel for the applicant heard.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 04.03.2018 and one daughter born from the said wedlock, who is about 41⁄2 years old, is in the care and custody of the applicant. TA-1379-2025 parties are residing separate. The applicant is not doing any work and she along with her daughter, is dependent upon her parental family. She has also filed petition under the Protection of Women from Domestic Violence Act, which is pending in the Courts at Batala and the respondent is pursuing the same. The distance between the two places is stated to be 50 kilometres.

In view of the submissions aforesaid, more particularly, considering the fact of applicant, to be taking care of the minor daughter, while she herself is not having any source of earning, as well as considering the fact of other litigation, to be pending in the Courts at Batala, which is pursued by the respondent and above it, considering the fact of respondent, not having come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act, i.e. HMA/472/2024, titled 'Gurpreet Singh Vs. Harwinder Kaur', filed by the respondent-husband, stands transferred from the Family Court, Amritsar, to the Court of competent jurisdiction at Batala. The requisite record of the aforesaid case be sent by the Family Court, Amritsar, to the District and Sessions Judge, Batala.

Learned District and Sessions Judge, Batala, shall assign the said petition to the Family Court, Batala. Even, the parties are directed to appear before the Family Court, Batala, within a period of one month from today onwards.
