IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M No. 62045 of 2024 (O&M) Date of Decision: 16.12.2024 Gurtej Singh .....Petitioner versus State of Punjab .....Respondent CORAM: HON'BLE MR. JUSTICE SHEEL NAGU, CHIEF JUSTICE Present :

Mr. Arshpreet Khadial, Advocate, (through v.c.) for the petitioner.

Mr. Gagneshwar Walia Addl. Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner has filed the present petition for grant of regular bail in case FIR No. 128 dated 09.08.2023 under Sections 302 and 323 read with Section 34 of the Indian Penal Code (Sections 302, 323, 325 IPC added later on) registered at Police Station Sardulgarh, District Mansa. 2.

The petitioner is in custody since 10.08.2023 for the commission of offence of murder. Though the investigation is over but considering the gravity of the offence and the fact that none of the prosecution witnesses have been examined, it would be appropriate that examination of the main prosecution witnesses to be completed before the bail application of the petitioner is considered. Therefore, the application of the petitioner for grant of regular bail is dismissed for the time being with liberty to come again after examination of main prosecution witnesses or if the trial gets further delayed, whichever is earlier.

3.

With the aforesaid liberty, the petition stands dismissed. (SHEEL NAGU) CHIEF JUSTICE 16.12.2024 ravinder Whether speaking/reasoned √Yes/No Whether reportable Yes/No√ RAVINDER KUMAR 2024.12.17 14:42 I attest to the accuracy and integrity of this document
