Versus
State of Punjab and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE MAHABIR SINGH SINDHU
Present:
None for the petitioner.
Mr.Japjot Singh, A.A.G., Punjab.
Mr. Rahul Aggarwal, Advocate, for Mr. Rahul Sharma, Advocate for respondent No.1. MAHABIR SINGH SINDHU, J.
Present writ petition has been filed under Article 226 of the Constitution, inter alia, for issuance of a Mandamus, directing respondent Nos.2 to 4 to protect the life & liberty of petitioner at the hands of respondent Nos.4 to 10.
2.
Case called twice, but there is no assistance on behalf of the petitioner.
3.
Heard learned counsel for the respondents and perused the paper-book.
4.
It appears that on account of some matrimonial differences with his wife-respondent No.5, petitioner has filed the present petition as a camouflage for seeking protection. Still further, from perusal of reply ATUL SETHI 2025.01.10 19:47 I attest to the accuracy and integrity of this document
CRWP-11982-2024 (O&M) filed by respondent No.11, it transpires that even maintenance was awarded to respondent No.5 by the Court of competent jurisdiction, but petitioner did not pay even a single penny and as a result thereof, suit for recovery has been filed before the Court of learned Additional Principal Judge, Family Court, Patiala (A-1).
5.
In view of above, this Court is of the considered opinion that present petition is a complete misuse of the process of Court; hence deserved to be dismissed with costs.
6.
However, taking a lenient view, petition is simply dismissed, without costs.
7.
Above observations be not construed as an expression of opinion on merits of the case, in any manner. Pending application(s), if any, shall also stand disposed off. 10.01.2025 (MAHABIR SINGH SINDHU) atulsethi JUDGE Whether speaking / reasoned :
