PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 483 of BNSS, 2023 for grant of regular bail to the petitioner in case F.I.R. No.112 dated 19.09.2021 registered for the offences punishable under Sections 302, 120B, 148, 149 of IPC at Police Station Bhogpur, District Jalandhar. 2.
As per the allegations levelled in the FIR it has been alleged as under :
"Statement of Joginder Singh son of Dall Singh resident of village and post office Bhatnura Lubana Police Station Bhogpur District Jalandhar, aged about 57 years, mobile No. 95017- 68310. I would like to state that I am resident of above noted address and I am retired as Hawaldar from Indian Army and presently I am working as security
guard in Indian Overseas Bank Sura Thussi Jalandhar. I have two sons and one daughter My son Surinder Singh is residing abroad France and my daughter Amaneep Kaur is married at village Umarpur near Mukeran. My son Gurinder Singh @ Lucky is aged about 26 and about six years ago he had performed love marriage with a girl namely Hardeep Kaur daughter of Surjit Singh resident of our village, due to which the relations between my son and his in- laws family were not cordial The Brother in Law of my son namely Maninder Singh alias Sabi and Varinderpal Singh alias Raja were having grudge against my son and sometimes they also quarreled to each other but the matter was compromised with the intervention of respectables of our village. Yesterday on 18.09.
2021 at around 8:30 PM, my son Gurinder Singh went out from the house and at about 9:40 PM, someone has informed me that quarrel between my son Gurinder Singh @ Lucky and his in- laws family is going on, therefore I along with my wife Balwinder Kaur reached at the in-laws house of Gurinder Singh @ Lucky where I saw that Maninder Singh @ Sabi and Varinderpal Singh alias Raja both Brothers-in-Law of my son and Rajinder Kaur Mother-inlaw of my son Gurinder Singh Lucky and their 2-3 unknown associates to whom I can identity on appearing before me, were causing injuries to my son Gurinder Singh with their Datar, Scissors, swords and sharp edge weapons. I raised hue and cry to save my son, then above said persons ran away from the spot along with their respective weapons.
where the doctors has declared my son died. I was under stress due to the death of my son and I called my relatives to Civil Hospital Kala Bakra. The above said persons had committed the murder of my son before my eyes by causing injuries to him. Legal action be taken against them and justice be provided to me. I left my relatives with the dead body of my son and came to the Police Station and got recorded my statement to you. xxx" 2.
Counsel for the State brings to the notice of this Court that on the body of the deceased there are two stab wounds. Scissor was recovered from the present petitioner. In the forensic examination DNA w.r.t. the blood on the scissor as well as the blood of the deceased has matched. The matter seems to that of honour killing.

Keeping in view the aforesaid forensic evidence against the petitioner, no ground for grant of regular bail is made out. Resultantly, the instant petition is dismissed.
