In deference to the directions issued by this Court on 09.12.2024, today the learned State counsel has filed reply, on affidavit of Dalbir Singh, PPS, Deputy Superintendent of Police, Baghapurana, District Moga, which is taken on record.

The reply (supra) makes revelation that, on the basis of the statement made by one Nirbhai Singh son of Pritam Singh, an FIR bearing No.235 dated 16.11.2024, under Sections 103/126(2)/191(3)/190 of the B.N.S., has been registered at P.S. Baghapurana, against: (i) Karam Dass @ Ghuga son of Resham Dass; (ii) Tarsem Lal @ Chitti son of Sewak Dass; (iii) Arjan Das @ Modu son of Mukhtiar Singh; (iv) Gaurav son of Jagsir Singh, residents of Dalip Basti, Baghapurana; (v) Akashdeep Singh @ Deep son of Jasvir Singh, resident of Smadh Bhai, Tehsil Baghapurana and unknown accused.

The detailed facts narrated in paragraph No.3 and 4 of the reply (supra) are reproduced hereunder:- "3. That the brief facts of the case are that complainant got recorded his statement with the police that his son Manpreet Singh @ Kancha is running his cement store at Dasuha. On 15.11.2024 complainant attended the cremation ceremony of Barkha Singh, where Modu son of Mukhtiar Singh insulted the DEVINDER YADAV 2024.12.13 13:14 I attest to the accuracy and authenticity of this order/judgment

CRWP-11879-2024 complainant and on 16.11.2024 said Manpreet Singh visited Baghapurana to meet his father. When Manpreet Singh @ Kancha came to know about this, then he asked the reason about same to said Arjun Das @ Modu @ Lovely, due to which hot words were exchanged between them. After sometime when Manpreet Singh @ Kancha was returning from market then Modu armed with Toka, Chitta armed with sword, Deep armed with Toka, Ghuga armed with sword, Gaurav and 8-9 unknown accused caused injuries on the person of Manpreet Singh @ Kancha, due to which said Manpreet Singh was died. During investigation of the case, accused Karam Das @ Ghuga, Tarsem Lal @ Chitti and Arjan Dass @ Modu have been arrested by the police. Whereas police is trying its level best to arrest the remaining accused, so investigation of the case is going on. During investigation of the case, on the basis of supplementary statement of complainant and his son Sharanjit Singh, one Kuldeep Kaur @ Keepa was nominated as accused vide DDR No.23 Dated 03.12.2024.

4. That during investigation said Kuldeep Kaur was called at police station and investigation was conducted from her. However, except said statements, no other evidence came on file to connect said Kuldeep Kaur with the crime, so she was sent back."

Moreover, it is specifically stated in the reply (supra) that, no lady member of the petitioner's family or his relative was ever apprehended by the police of P.S. Baghapurana, rather false allegations have been levelled by the petitioner.

In view of what has been stated in the reply (supra), this Court deems it appropriate to close the instant petition. 6.

Disposed of accordingly.
