Seeking issuance of directions to respondents No.1 & 2 to take legal action against respondents No.5 & 6 for taking forcible possession of plot of the petitioner and to take legal action against respondents No.3 & 4 for helping respondents No.5 & 6, petitioner has come up before this Court by filing the present petition under section 528 BNSS 2023.

Notices are served upon the official respondents through the State's counsel. Given the nature of the order that this Court proposes to pass, neither the response of official respondents nor the issuance of notices to the private respondents is required. 3.
Counsel for the State on instructions from SI Harbhajan Lal, has taken preliminary objection that they had not received any representation annexed as Annexures P-6 to P-8.

Petitioner's counsel submits that they had handed over representation to the concerned authority, however he would be contended and satisfied if he is permitted to file a fresh representation and the same is decided by the concerned Officer in time bound manner.

Given above, let the petitioner represent to the concerned Commissioner of Police within 15 days from today. If the petitioner files a representation with in the aboveANJU RANI 2024.12.17 14:57 I attest to the accuracy and integrity of this document Punjab and Haryana High Court Chandigarh
CRM-M-62438-2024 mentioned time period of 15 days, then, the same shall be decided by the concerned Commissioner of Police, within two months from that day. It is clarified that such order must be a reasoned order, and the same be communicated to the representationists as well as his counsel, without any delay. In the representation, petitioner to mention the e-mail-id of his counsel so that the concerned officer could communicate them outcome.

Liberty reserved to the petitioners to file fresh petition or to take other legal remedies in accordance with the law.

It is clarified that there is no adjudication on merits. It is further clarified that this order shall not come in the way if the interrogation of the petitioners is required in any cognizable case.

There would be no need for a certified copy of this order, and any Advocate for the Petitioners and State can download this order and other relevant particulars from the official web page of this court and attest it to be a true copy. The concerned officer can also verify its authenticity and may download and use the downloaded copy for immediate use.
