complainant Sandeep gave his statement that his sister Jyoti was married to Sunny in the year 2016. She was mother of 03 daughters. His brother-in-law started harassing his sister for the last about 1 1⁄2 /2 years as he had affair with another lady Vanshika Yadav. He tried to make his brother-in-law understand and requested him to stop harassing his sister. Even Vanshika Yadav used to threaten his sister by calling her. On 27.08.2024 his sister was alone in the house and Sunny


forced her to consume poisonous substance, as a result of which she died. 3.

Learned counsel for petitioner argued that the allegations levelled against petitioner are false. There is nothing on record to show that petitioner forced the deceased to consume poisonous substance. There is no direct evidence to connect him with the said crime. Petitioner was arrested in this case on 28.08.2024 and till date he is behind the bars. Challan is already presented and the prosecution evidence is being recorded. Learned counsel for petitioner referred to the statements of witnesses examined in this case i.e. Sandeep (complainant) as PW-1, Naveen (brother of the victim) as PW-2 and Kuldeep (cousin of the victim) as PW-3 and all these witnesses did not support the prosecution case. Trial in this case will take long time. He is ready to abide by the terms and conditions of bail order. Therefore his regular bail petition may be allowed.

Bail petition is opposed by learned counsel representing State taking the stand that it is a case of unnatural death of the victim in the matrimonial home. The allegations are serious, therefore, petitioner is not entitled to be released on bail.

I have considered the arguments and have gone through the record. In the case in hand trial is going on. Petitioner is behind the bars since 28.08.2024. All material prosecution witnesses examined till date i.e. Sandeep PW-1, Naveen PW-2 and Kuldeep PW-3 as referred above, did not support the prosecution case. Learned trial Court will appreciate the testimony of prosecution witnesses at relevant time. Therefore, without expressing my mind on merits of the case,  $
