Dated Police Station Sections 05.04.2018 Sadar Khanna, District Ludhiana 409, 120B IPC Seeking quashing of above captioned FIR, petitioner has come up before this Court by filing the present petition under Section 528 BNSS 2023. 2.

After arguing for some time, petitioner's counsel submits that he wants to withdraw the present petition and further prayed that since the cancellation report is filed, he will be contended and satisfied if his personal appearance is exempted till his personal appearance is not required by the concerned trial Court and he be permitted to appear through counsel.

Given above, petition is disposed of as withdrawn. Petitioner is at liberty to file application for exemption from personal appearance before the trial Court and if such application is filed, trial Court shall consider the same and exempt his personal appearance if his presence is not required, subject to condition that his counsel shall appear on each and every date of hearing. It is clarified that if petitioner's counsel does not appear before the trial Court, this order shall stand recalled automatically under Section 403 BNSS 2023. Pending applications, if any, stand disposed of.
