Mr. Rajat Gautam, Additional Advocate General, Haryana. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.298 dated 19.10.2024 under Sections 118(1), 351(3), 109(1) of the BNS, 2023, registered at Police Station Urban Estate, Hisar. 2.

Vide order dated 09.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned State counsel, on instructions has not disputed that the petitioner had been granted the concession of regular bail by the Court of learned JMIC, Hissar on 25.10.2024; offence under Sections 109 and 351(3) of the BNS, 2023 was added later on without there being any specific medical opinion in the said regard. However, it has been asserted that offence under Section 109 and 351(3) of the BNS had been added on the statement made by both the injured persons including the complainant."

Learned counsel for the petitioner submits that in compliance of order dated 09.01.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 09.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
