Present petition has been filed by the petitioner under Section 528 of BNSS for quashing of order dated 24.07.2025 passed by learned Judicial Magistrate Ist Class, Chandigarh, vide which the petitioner has been declared as proclaimed person in complaint case bearing No.NACT-928-2023 titled 'Smayan Health Care Pvt. Ltd. Vs. Sinag Healthcare Pvt. Ltd.' 2.

Learned counsel for the petitioner contended that the petitioner was Director of the firm at the relevant time when the cheque in question was issued, however, he was not the signatory of cheque in question. Learned counsel further contended that the petitioner was not properly served as he is not residing at the address mentioned in the complaint. Learned counsel submitted that the petitioner is ready to surrender himself before the learned trial Court and prays that the petitioner be not arrested by the police. Keeping in view the contentions raised by learned counsel for the petitioner, the petitioner is directed to surrender himself before the learned trial Court on the date fixed i.e. 18.12.2025 and to move an appropriate application by raising all the pleas taken in this petition, before the trial Court regarding his non-appearance. The trial Court is directed to decide his bail application in accordance with law. Till then, he will not be arrested by the police in this matter. It is made clear that if he fails to appear before the trial Court within stipulated time then the relief granted by this Court shall be deemed to be withdrawn.

Petition is accordingly disposed of.
