Dated Police Station Sections 18.04.2024 City Dabwali 15C/27A/29/61/85 of NDPS Act The petitioner incarcerated in the FIR captioned above had come up before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking regular bail.

Counsel for the petitioner seeks bail on the ground that Form 29 was not sent. In the opinion of the Court, it is matter subject to opportunity to the witnesses police officials for cross-examination and cannot be a ground of bail. Counsel for the petitioner further submits that petitioner is a first offender. 3.

On the other hand, State counsel submits that quantity involved is commercial and Section 37 of NDPS Act does not give any relaxation to the first offenders who are involved in cases falling under commercial quantity. Petitioner is not entitled to bail on these grounds.

At this stage, counsel for the petitioner wishes to withdraw the present petition with liberty to file fresh in accordance with law. 5.
