The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.104 dated 20.06.2025 registered under Sections 109, 115(2), 126(2) and 351(2) of BNS (Section 109 BNS deleted and Section 117(2) BNS added later vide DDR No.8 dated 20.09.2025) at Police Station Model Town, District Ludhiana. 2.
The learned counsel for the petitioner contends that taking the prosecution case to be correct, the petitioner has only attributed an injury attracting Section 325 Cr.P.C. (Section 117 BNSS). As the petitioner is in custody since 21.06.2025 but none of the 13 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. CRM-M-60870-2025 -23. On the other hand, the learned State counsel contends that the petitioner is the main accused having assaulted the child. Therefore, he is not entitled to the concession of bail as prayed for. He, however concedes that the petitioner is in custody since 21.06.2025 but none of the 13 prosecution witnesses has been examined so far.

I have heard the learned counsel for the parties. 5.
The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is a first-time offender, in custody since 21.06.2025 but none of the 13 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required.

Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Jaswinder Singh @ Jaswinder Singh Kathuria @ Garry S/o Lt. Harjit Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned.
