Petitioner is seeking the concession of anticipatory bail in FIR No.117 dated 23.11.2024 under Sections 109/118(1)/115(2)/191(3)/190 of the BNS, 2023, registered at Police Station Kalanaur, District Gurdaspur. 2.

On the last date of hearing on 18.12.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned counsel for the petitioner, inter alia, contends that although the petitioner has been named in the FIR in question, however, even as per the allegations levelled in the FIR, the petitioner was empty-handed; the only attribution qua the petitioner is of having raised a lalkara" 3.

Learned counsel for the petitioner submits that in compliance of order dated 18.12.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Harpal Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 18.12.2024, is made absolute subject to the conditions laid down in Section 482(2) of BNSS, 2023.
