Mr. Amit Rana, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.180 dated 18.11.2024, under Sections 118, 115(2), 191(3), 190, 238(1), 133 of the B.N.S., 2023, registered at Police Station City Gurdaspur.

Vide order dated 12.12.2024 passed by a coordinate Bench, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "The learned counsel for the petitioner inter alia submits that, even if the allegations levelled in the present FIR are taken to be a gospel truth, yet no specific injury is attributed to the petitioner, rather the only role attributed to the petitioner is that, he raised Lalkara and caught hold the complainant. Moreover, the petitioner has no criminal antecedents and he is ready to join the investigation and to cooperate with the investigating officer."

Learned counsel for the petitioner submits that in compliance of order dated 12.12.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.
Short reply by way of affidavit of Deputy Superintendent of Police, City, District Gurdaspur, has been filed in Court, which is taken on record.

Learned State counsel, on instructions from ASI Jagjeet Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 6.
In view of the above, the petition is allowed and interim order dated 12.12.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
