Case of the prosecution is that petitioner-Davinder Singh @ Davinder Pal Singh, in connivance with other co-accused impersonated as Sukhdev Singh and prepared a false GPA dated 09.02.2023 in favour of co-accused Parampal Singh and thereon, on the strength of GPA dated 09.02.2023, one sale deed was

execution in regard to the land measuring 99 kanals and 18 marlas situated at village Gujjar, Tehsil Sadiq, District Faridkot. 3.

Learned counsel for the petitioner argues that two of the co-accused namely Parampal Singh in whose favour GPA was executed and transferee of the land namely Khushwant Pal Singh Brar, who is real beneficiary, they both have been granted bail by this Court vide order dated 28.07.2025 passed in CRM-M18748-2025 (Annexure P-3) and order dated 29.08.2025 passed in CRM-M-46867 (Annexure P-4). He further submits that offences are triable by the Court of learned Magistrate and only on the basis of photographs and the signatures, though disputed by the petitioner, he can not be termed of being involved in the present crime. The charges need to be proved beyond doubt. Thus, learned counsel prays for grant of bail.

On the other hand, learned State counsel has vehemently opposed the prayer made in the petition and points out that such instances are increased in the State of Punjab and a big fraud has been played at the behest of the petitioner, who himself appeared before the office of Sub Registrar as real owner Sukhdev Singh and then got executed the sale deed in favour of Khushwant Pal Singh Brar. 5.

I have heard learned counsel for the parties and examined the relevant material available on record with their able assistance. 6.

Undisputedly, the allegations are triable by the Court of learned Magistrate. Co-accused Khushwant Pal Singh Brar and Parampal Singh have already been released on bail by this Court vide order dated 28.07.2025 passed in CRM-M-18748-2025 and vide order dated 29.08.2025 passed in CRM-M-46867. Conclusion of trial may take considerable time, as there are total 10 prosecution witnesses and none has been examined till date, thus, this Court deems it

appropriate to consider his plea of bail.

Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 8.

Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 9.

The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record. 10.

It is further made clear that if, in future, petitioner is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled. 11.

Petition stands disposed of.
