Prayer in this petition, filed under Section 483 of the BNSS, 2023, is for grant of regular bail to the petitioner, who has been booked for having committed the offences punishable under Sections 21, 29 of NDPS Act, and Sections 18(c) and 27 of Drugs and Cosmetics Act, in a case arising out of FIR No. 26, dated 17.03.2023, registered at Police Station Linepaar Bahadurgarh, District Jhajjar.

Recovery in the present case is of 70 injections of Pheniramine Maleate Injection IP 10 ml each (700 ml) and 70 Buprenorphine Injection IP Leegesic 2 ml each (140 ml) from three accused whereas recovery from the person of each accused including the petitioner is of 5 injections of Buprenorphine Injection IP Leegesic 2 ml each and rest contraband was recovered from the backseat of the car.

Learned counsel for the petitioner submits that the alleged recovery falls under the commercial quantity and the petitioner is inside the jail for the last about 02 years i.e. since 17.03.2024. Learned State counsel informs that out of total 18, 10 of the prosecution witnesses have already been examined and all remaining witnesses have been summoned for 04.03.2024. She also ensures that the trial would be culminated in next two to four months. 5.

At this stage, learned State counsel filed status report by way of affidavit of Rajender Singh, HPS, Assistant Commissioner of Police Bahadurgarh, District Jhajjar, on behalf of respondent-State in Court today and the same is taken on record. Copy thereof has been supplied to learned counsel opposite.

Relying upon the statement made by learned State counsel, learned counsel for the petitioner prays that the present petition may kindly be disposed of having been not pressed any further, at this stage. 7.

The instant petition is disposed of having been not pressed, at this stage.
