(Oral) The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondent - Corporation to remove the anomaly which has been illegally created by the respondent - Corporation in contravention of the principle of equality as enshrined in the Constitution of India under Article 14 i.e. principle of equality amongst equals, by not granting the service benefit of 16 years scale to the present petitioner as has been granted to the similarly placed junior employee namely Harinder Singh. Further prayer has been made to direct respondent - Corporation to re-fix the salary of the petitioner before retirement and consequently to re-fix the pension of the petitioner after making a fresh calculation by a duly granting similar MOHD YAKUB 2024.12.16 16:43 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CWP No.33905 of 2024 benefit to the present petitioner as has been granted to the similarly placed junior employee namely Harinder Singh. Lastly, it is prayed that the respondent - Corporation be directed to grant the arrears along with interest @ 18% per annum, after re-fixation of salary and consequently, the re-fixation of pension of the petitioner till the date of payment of arrears.

After arguing the case for some time, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file afresh, on the same cause of action, with better particulars.
