The present petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR No. 0681 dated 21.11.2024, under Sections 108 and 3(5) of BNS, 2023, registered at Police Station Suraj Kund, District Faridabad (Annexure P-1). 2.
Vide order dated 13.12.2024, a Co-ordinate Bench of this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation and in compliance thereof, learned State counsel has filed the status report by way of an affidavit of Monica, HPS, Assistant Commissioner of Police, NIT Faridabad on behalf of respondentState, which is taken on record, subject to all just exceptions. 3.
Learned State counsel on instructions from SI Javed Khan, submits that although the petitioner has joined the investigation, however, his presence would be required for further investigation and the petitioner be bound down to appear before the Investigating Officer as and when called upon.

Learned counsel for the petitioner submits that the petitioner has been cooperating in the investigation and undertakes to cooperate even further.

In light of the above, the present petition is allowed. The order dated 13.12.2024 granting interim anticipatory bail to the petitioner, is made absolute with a condition that the petitioner shall appear before the Investigating Officer as and when called for, however, the same is with a rider that the Investigating Officer will not call upon the petitioner unnecessarily to harass him. The petitioner shall join the investigation as and when called upon to do so by the Investigating Agency, and shall abide by the conditions of Section 482 of BNSS, 2023. 6.
However, nothing stated above shall be construed as a final expression of opinion on the merits of the case. 7.
It is made clear that, in case, the petitioner is found involved in any such activity once again, the present concession granted shall automatically stand vacated.

It is further made clear that this order shall not be construed as parity qua any other co-accused.
9.
Pending miscellaneous application, if any, shall stand disposed of.
