The petitioner is seeking quashing of order of proclamation dated 16.11.2024 (Annexure P-19) passed by concerned Judicial Magistrate Ist Class in FIR No.183 dated 25.12.2021 (Annexure P-1) under Section 420, 417, 120B IPC registered at Police Station City Division No.2, Pathankot whereby the petitioner has been declared as a proclaimed person / Offender in aforementioned FIR.

Learned counsel for the petitioner contends that the petitioner has undergone kidney transplant and for that purpose, he has shifted from Pathankot to Chandigarh and therefore, he could not appear before the Court as he was bed ridden for sometime and as of today also, he is not completely fit on medical ground. However, he submits that he is willing and ready to join the proceedings and shall appear before the trial Court concerned. Learned counsel for the petitioner, on instructions further submits that the petitioner undertakes to appear before the trial Court concerned on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before Sonia Puri 2025.05.28 09:52 I attest to the accuracy and integrity of this document
CRM-M-63139-2024 -2the trial Court. Hence, in the aforementioned facts and circumstances, the petitioner prays that directions be issued to the Trial Court concerned that his bail application, which he would be filing on his surrender, be decided. 3.
Keeping in view the facts of the case, the service of respondent is dispensed with as it will delay the proceedings. 4.
I have heard learned counsel for the petitioner and perused the material placed on record.

No ground to interfere in the impugned order dated 16.11.2024 is made out and the present petition is hereby, disposed of. 6.
However, the petitioner shall appear and surrender before the trial Court concerned within a period of 14 days from today and may file an application for bail. In case, he appears within the stipulated period, the trial Court is directed to consider and decide the same on the very same date. 26th May, 2025 (H.S.
