Advocate General, Haryana. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner apprehends his arrest in respect of offences punishable under Sections 417, 420 and 120-B of the Indian Penal Code in FIR No. 117 dated 16.08.2024 registered at Police Station Ghuman, District Gurdaspur.

The petitioner was granted interim bail by this Court vide order dated 13.12.2024 on certain terms and conditions. 3.
Affidavit of the concerned Police officer indicates that though the petitioner has no criminal antecedents and he has joined investigation but he is not cooperating with the Investigating Agency as the money involved has not yet been recovered.

Since the petitioner has already joined the investigation, it is for the Investigating Agency to adopt all possible legitimate means to ensure recovery of money for which the petitioner cannot be held responsible as the criminal jurisprudence of this country allows an accused to stay silent during the process of investigation.

Keeping in view the above, the order dated 13.12.2024 passed by this Court granting interim anticipatory bail to the petitioner stands continued and confirmed on the terms and conditions mentioned in the order. 6.
This order shall also remain subject to the following condition: - i) During this monsoon season, the petitioner shall plant 15 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned Police Station where the FIR has been registered within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.

The petition stands allowed.
