Mr. Karan Singla, Advocate for the complainant. The present petition has been filed seeking grant of regular bail to the petitioner in case FIR No.97, dated 31.10.2024, under Sections 64 and 351(3) of BNS, 2023, registered at Police Station Sadar Ahmedgarh, District Malerkotla, (Annexure P-1).

Learned counsel for the petitioner submits that the petitioner is a young man aged 26 years, whereas the complainant/prosecutrix is a lady aged about 35 years. It is further submitted that the prosecutrix was initially married, and her first husband expired in the year 2013. Thereafter, she entered into a second marriage in the year 2016 but disputes arose between them, as her second husband was allegedly a drug addict and litigation ensued between them. Learned counsel submits that the petitioner and the prosecutrix were in a consensual relationship for a considerable period of time. It is further submitted that, as per the allegations themselves, the

incident is stated to have taken place in December 2022; whereas, the FIR in the present case was lodged only on 31.10.2024, thereby, indicating substantial delay in lodging the FIR.

Learned State counsel has filed the status report by way of an affidavit of Mr. Sukhdev Singh Brar, PPS, Deputy Superintendent of Police, Sub-Division Ahmedgarh, District Malerkotla on behalf of respondent-State in Court today, which is taken on record, subject to all just exceptions.
