The present contempt petition has been filed for deliberate and intentional disobedience of order dated 08.08.2025 passed by this Court in CRWP-8573-2025, whereby respondent No.2-Senior Superintendent of Police, Pathankot, was directed to take a decision on the representation submitted on behalf of the petitioner in accordance with law. 2.

In compliance of the aforesaid order dated 08.08.2025 passed by this Court in CRWP-8573-2025, compliance report by way of affidavit dated 12.11.2025 of Sh. Daljinder Singh Dhillon, PPS, Senior Superintendent of Police, District Pathankot, along with Annexure R1/T, has been filed. The relevant portion of the said report is reproduced as under:-

-2- "6 That the then Deputy Superintendent of Police (Detective), District Pathankot conducted an investigation into the abovesaid representations given by the petitioner along with other persons and submitted the investigation report on 20.09.2025. Following observations were made during investigation:

i.

FIR No. 41 dated 21.03.2025 U/s 109, 115(2), 126(2), 191(3), 190 of BNS, 2023 was registered at Police Station: Division No. 2, District Pathankot on the basis of a statement given by complainant namely Anirudh Singh @ Munna (son of Avtar Singh) against 3 persons namely Bandhan Sharma @ Janu, Saurav Saini and Rajat Malhotra along with unknown persons. The contents of the FIR are hereby not reproduced as the same has been annexed with the petition as ANNEXURE P/2. It is pertinent to mention that FIR No. 41 (supra) was registered against the accused persons for causing injuries to Anirudh Singh @ Munna ard Akshit Sharma on 19.03.2025.

That during investigation, it came to light that prior to the incident in which Anirudh Singh @ Munna and Akshit Sharma received injuries on 19.03.2025 which led to registration of FIR No. 41 (supra) against Bandhan Sharma @ Janu, Saurav Saini and Rajat Malhotra, second party Anirudh Singh a Munna (complainant main case) and Akshit Sharma had caused beatings and given injuries to Saurav Saini and Rajat Malhotra at Guru Nanak Park, Model Town, Pathankot. The said fact was duly recorded in a video footage wherein Anirudh Singh @ Munna and Akshit Sharma are seen giving beatings to Saurav Saini and Rajat Malhotra. Furthermore, statements of as many as 12 persons were recorded who had corroborated the said fact. The persons whose statements were recorded are:

 Suresh Saini, son of Mohal Lal  Harsh, son of Jameet Rai  Bodh Raj, son of Joginder Pal  Sahil Khosla, son of Ravinder Khosla  Raman Kumar, son of Tirath Ram  Mukesh Gupta, son of Prem Kumar  Amit alias Rocky, son of Dharampal

-3-  Tushar, son of Pankaj Puri  Saurav Mehra, son of Ashok Kumar  Meenu, wife of Saurav Saini  Neelam Saini, wife of Joginder  Pawan Kumar, son of Dharampal.

iii Hence, Saurav Saini and Rajat Malhotra were not found to be present at the place of incident where Anirudh Singh @ Munna and Akshit Sharma were given beatings as the said persons were already injured due to beating caused to them by Anirudh Singh @ Munna and Akshit Sharma. Hence, it was recommended that Saurav Saini and Rajat Malhotra be declared innocent in FIR No. 41 (supra).

During investigation, it further came to light that on 19.03.2025, after Anirudh Singh @ Munna and Akshit Sharma along with Divansh Singh, Harman and Sarabjit Singh had given beating and caused injuries to Saurav Saini and Rajat Malhotra, they fled from the spot. Thereafter, Bandan Sharma @ Janu along with Sachin Bhandari, Sunny and Paras, so as to take revenge, caused injuries to Anirudh Singh @ Munna and Akshit Sharma. Hence, it was recommended that Sachin Bhandari (resident of in front of Hanuman Temple, Model Town, Pathankot), Sunny (son of Diala) and Paras (resident of Bajri Company, Pathankot) be nominated as an accused in FIR No. 41 (supra). v.

That furthermore, it was recommended that a cross-case U/s 115(2), 126(2), 191(3), 190 of BNS, 2023 be registered against Anirudh Singh @ Munna and Akshit Sharma along with Divansh Singh, Harman and Sarabjit Singh.

As per MLR(s) of Anirudh Singh @ Munna and Akshit Sharma, they had received 6 injuries and 1 injury respectively - all caused by blunt weapon. vii.

As per MLR(s) of Saurav Saini and Rajat Malhotra, they had received 3 injuries and 4 injuries respectively - all caused by blunt weapon. viii.

The complainant/injured in FIR No. 41 (supra) Anirudh Singh @ Munna had stated that the accused persons had caused injuries upon him with an intention to kill. However, all the injuries

-4suffered by him were declared to be simple in nature. Hence, it was recommended that offence purishable U/s 109 of BNS, 2023 be deleted in FIR No. 41 (supra).

ix.

The injured Akshit Sharma in FIR No. 41 (supra) had received one injury ie. Compound Fracture Left Tibia which was caused by blunt weapon.

Hence, it was recommended that offence punishable U/s 117(2) of BNS, 2023 be added in FIR No. 41 (supra).

That agreeing with the recommendations of Deputy Superintendent of Police (Detective, District Pathankot, the Deponent forwarded the same to Deputy Superintendent of Police (Detective), Pathankot and SHO, Police Station: Division No. 2, District Pathankot for necessary compliance. Hence, the representation given by the petitioner and other persons were closed on 01.10.2025 and 06.10.2025. A true translated copy of the report of Deputy Superintendent of Police (Detective), District Pathankot is placed on record as ANNEXURE R1/T"

A perusal of the compliance affidavit as well as report, which is placed on record as Annexure R1/T, shows that order dated 08.08.2025 passed by this Court in CRWP-8573-2025 has been complied with. 4.

In view of the above, since order dated 08.08.2025 passed by this Court in CRWP-8573-2025 has been complied with, therefore, the present contempt is purged and rule stands discharged. 5.
