The petitioner apprehends his arrest in respect of offences punishable under Sections 127 (2), 137 (2), 115 (2), 351 (2), 351 (3) and 110 of the Bharatiya Nyaya Sanhita, 2023 (Section 318(4) of BNS, 2023 added later on), registered at Police Station Sri Chamkaur Sahib, District Rupnagar, vide FIR No. 52 dated 20.07.2024.

The petitioner, who has no criminal antecedents, is alleged to be running an unlawful de-addiction center, where he had kept inmates confined and was charging money from them. The inmates fled and escaped reconfinement. All the offences, except Section 110 of the BNS, 2023, alleged against the petitioner, are bailable in nature. 3.
On being enquired from the learned State counsel as to whether the petitioner's custodial interrogation is required or not, it is submitted that certain relevant documents are to be recovered from the petitioner and his statement is also to be recorded. It is also submitted that co-accused has been AMODH SHARMA 2024.12.20 18:04 I attest to the accuracy and authenticity of this order/judgement
-2CRM-M-63415-2024 (O&M) granted anticipatory bail by this Court vide order dated 03.12.2024 (Annexure P-2) 4.
This Court, in the absence of criminal antecedents of the petitioner, extends him benefit of anticipatory bail, subject to his furnishing personal bond in the sum of Rs.1,00,000/- with two sureties of the like amount each to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall appear in the concerned Police Station on 24.12.2024 at 10.00 AM and submit all the relevant documents, which are in his possession, and thereafter keep appearing as and when required by the police. He shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. In case the petitioner does not join the investigation, the State is free to move an application for cancellation of his bail.

This order shall also remain subject to the following condition:- The petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned Police Station where the FIR has been registered within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail. 6.
The petition stands allowed.
