CRM M No. 63242 of 2024 The petitioner is before this Court seeking regular bail in regard to an offence of cheating arising out of an incident where he duped the complainant of an amount of Rs. 13,63,500/- through online transaction as alleged in FIR No. 58 dated 16.04.2024 under Section 420 of the Indian Penal Code registered at Police Station Cyber Crime, Panipat, District Panipat.

The investigation in the matter is over by filing charge-sheet on 30.09.2024 qua the petitioner and therefore, need for custodial interrogation stands obviated.

Considering the fact that petitioner has no criminal antecedents and the investigation is over, this Court extends the benefit of regular bail to the petitioner subject to his furnishing personal bonds for a sum of Rs.50000/- with two sureties of the like amount each to the satisfaction of trial Court/Duty Magistrate (one of the sureties should be of local area).

It is made clear that the observations made herein shall not be construed to be an expression of opinion on the merits of the case. 5.

This order shall also remain subject to the following condition:- i) The petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned trial Court within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.

The petition stands allowed.
