*** NIDHI GUPTA, J. (ORAL) Prayer in the present petition under Section 528 of BNSS 2023 is for issuance of directions to respondents No. 1 to 3 to conclude the investigation of case/FIR No. 119 dated 28.12.2023 under Sections 406 and 498-A IPC registered at Police Station Women Cell, Jalandhar against respondents No. 4 and 5 within stipulated time period, as per law. Learned counsel for the petitioner/complainant/wife inter alia submits that despite the fact that the present FIR pertains to the year 2023, yet investigation has not been concluded. It is submitted that respondent No. 4/husband of the petitioner was granted anticipatory bail by this Court, vide orders dated 13.05.2024 and 31.07.2024 passed in CRM-M-23744-20204; whereafter he has left the country. It is submitted that the petitioner has filed a petition bearing No. CRM-M-58437-2024 for cancellation of the above bail granted to respondent No.4, which is now fixed for 08.01.2025. Learned counsel for the State informs this Court that pursuant to order dated 13.05.2024 passed by this Court in CRM-M-23744-2024 titled as Rajveer Singh vs. State of Punjab and another, the respondent No.4 had joined investigation on 29.07.2024; whereafter anticipatory bail of respondent No.4 was made absolute by this Court vide order dated 31.07.2024. It is further submitted, on instructions from ASI Rajesh Kumar, that challan against the respondents No.4 and 5 has been prepared in the present case on 09.08.2024 however, cannot be presented before the learned trial Court as respondent No.4 has absented himself from the proceedings. It is submitted that therefore, the investigation in the present case stands completed.
Learned counsel for the petitioner submits that in view of the above statement made by the learned counsel for the State, the present petition may be disposed of as no further directions are required to be issued.
Ordered accordingly.
