The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 09.03.2024 passed in Civil Suit No.3231 of 2021 to the extent statement of petitioner qua her ownership over suit property has been recorded.

There is dispute between petitioner and her husband namely Vijay Kumar. A civil suit came to be filed by Vijay Kumar with respect to few properties. The petitioner made a statement before National Lok Adalat to the effect that she or her parents did not contribute in the purchase of suit properties. The petitioner is apprehending that respondent taking advantage of aforesaid statements may oust them from said properties.

Learned counsel for the petitioner submits that petitioner's statement recorded before National Lok Adalat may be ordered to be ignored.

There is no dispute that petitioner had voluntarily tendered her statement before National Lok Adalat. She had conceded that she did not contribute in the price of suit properties. The petitioner is not even today disputing that there was no contribution by her in the purchase of suit properties.

The properties are in the name of petitioner and she cannot be ousted from said properties except in accordance with law. Thus, her apprehension is mis-conceived.
