Mr. HS Deol, Sr. Deputy Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner is seeking regular bail in case FIR No. 229 dated 03.09.2024 under Sections 62, 351, 308(5) of the Bharatiya Nyaya Sanhita-2023 and Sections 25 and 27 of the Arms Act, 1959 registered at Police Station Jandiala, District Amritsar Rural. 2.

The petitioner is in custody since 04.09.2024 and the charge sheet in the matter after investigation has been filed on 02.12.2024. 3.

Though the petitioner has a criminal antecedent of similar nature of the year 2022 in which he is on bail but considering the fact that charge sheet has been filed and custodial interrogation is no more required, this Court extends the benefit of regular bail to the petitioner subject to his furnishing personal bonds for a sum of Rs.50000/- with two sureties of the like amount each to the satisfaction of trial Court/Duty Magistrate. It is made clear that the observations made herein shall not be construed to be an expression of opinion on the merits of the case. 5.

This order shall also remain subject to the following condition:- i) The petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned trial Court within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.
