***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/456/2025, titled 'Harshdeep Singh v/s Rajvir Kaur", filed by the respondent-husband, pending in the Family Court, Faridkot and she seeks transfer of the same to Family Court, Jagraon, District Ludhiana. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 11.06.2025, but no child was born from the said wedlock. Unfortunately, the matrimonial dispute arose between the parties and they are residing separate. TA-1410-2025 pursued B.A., B.Ed., but however, she is not having any source of earning and is dependent upon her parental family. It is also submitted that the respondent is a government teacher, who is posted at Mohali, but he has filed the petition at Faridkot, which is his parental place. The applicant has also filed one complaint before Senior Superintendent of Police, Jagraon, District Ludhiana, which is pending inquiry. The distance between the two places is stated to be 90 kms.

In view of the submissions aforesaid, more particularly, considering the fact of the applicant to be not having any source of earning and also the petition having been filed at Faridkot, which is the parental place of respondent, who himself is posted at SAS Nagar and also taking into consideration the fact of the respondent, having not come forward to resist the transfer application, the same is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/456/2025, titled 'Harshdeep Singh v/s Rajvir Kaur", filed by the respondent-husband, stands transferred from the Family Court, Faridkot, to Family Court (Camp Court), Jagraon, District Ludhiana. The requisite record of the aforesaid case be sent by the Family Court, Faridkot, to the District and Sessions Judge, Ludhiana. Learned District and Sessions Judge, Ludhiana, shall assign the said petition to Family Court (Camp Court), Jagraon. Even, the parties are directed to appear before Family Court (Camp Court), Jagraon, within a period of one month from today onwards.
