Faced with the above, learned counsel for the petitioner prays for withdrawal of the present petition at this stage; however, further prays that appropriate directions be issued to the learned Trial Court and the prosecution agency to examine the material witnesses expeditiously, as the petitioner has been in custody for more than ten months. 4.

In view of the above, the present petition is dismissed as withdrawn at this stage, without expressing any opinion on the merits of the case. The learned Trial Court is directed to ensure that the material witnesses, particularly the victim, are examined as early as possible and in accordance with law.
