Learned counsel would contend that the petitioners were joined on Class-IV posts through out sourcing in ESI Department between 2008 and 2014, and continued till 2014/2021, however, after the Department of Contractual Persons Policy, 2022, they have not been allowed to rejoin, while other similarly situated have been re-engaged as averred in para 8 of the petition, pursuant to the orders passed by this Court on 02.07.2024, Annexure P-3, copy of one such order of Sahid is appended as Annexure P-4,. In this regard, a legal notice dated 14.08.2024, Annexure P-5, has been served upon respondents, but the same has yet not evoked any response. He thus, at this stage, on instructions from the petitioners prays that a direction is given to the respondents to decide the same in a time bound manner.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 14.08.2024, in accordance with law, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same shall contain reasons and the petitioners shall be free to seek legal redress thereupon. ! " #
