MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.51 dated 28.10.2024 under Sections 115(2), 118(1), 126(2), 3(5), 324(4), 351(2), 118(2), 109 of the BNS, registered at Police Station Behrampur.

Vide order dated 18.12.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner, inter alia, contends that a false and fabricated case has been planted upon the petitioner, which is evident from the fact that although a video was prepared of the occurrence in question, however, the petitioner is not visible in the said video; the only role attributed to the petitioner is of having smashed the car windows of the complainant's nephew and inflicting a simple injury on the head of the complainant himself, who was following the car of his nephew."

Learned counsel for the petitioner submits that in compliance of order dated 18.12.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions from ASI Jagir Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 18.12.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
