This application has been filed for preponement of the date of hearing of the main case which is otherwise fixed for 27.11.2025. For the reasons mentioned in the application and having no objection from the opposite counsel, the same is allowed. The date of hearing in the main case is preponed to today and the main case is taken up on Board today itself.

Main case:

The present petition has been filed under Section 528 of Bharatiya Nagrik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of complaint bearing No.COMI/0000033/2024, dated 22.01.2024 registered under Sections 378, 379, 384, 388, 389, 406, 415, 419, 420, 467, 468, 500,

-2506, 201, 120-B, 34 IPC and summoning order dated 18.10.2024 (Annexure P-21) and all the subsequent proceedings arising therefrom, on the basis of compromise dated 16.01.2025 (Annexure A-1).

This Court vide order dated 05.02.2025 had directed the parties to appear before the trial Court to get their statements recorded and the learned Magistrate was directed to send its report qua the genuineness of the compromise.

Pursuant to the aforesaid order, parties have appeared before the learned District and Sessions Judge, Faridabad and got their statements recorded. On the basis of the statements so recorded, learned Judge has submitted report dated 18.03.2025 to the effect that the compromise has been effected between the parties voluntarily and without any coercion or undue influence.

Learned counsel for the respondent has not disputed the factum of compromise between the parties.

In view of the above, no useful purpose would be served to continue with the proceedings before the trial Court in the instant complaint. 6.

Following the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and others Versus State of Punjab and another 2007 (3) RCR (Criminal) 1052 and approved by the Hon'ble Supreme Court in Gian Singh Versus State of Punjab and others (2012) 10 SCC 303, this petition is allowed and complaint bearing No.COMI/0000033/2024, dated 22.01.2024 registered under Sections 378, 379, 384, 388, 389, 406, 415, 419, 420, 467, 468, 500, 506, 201, 120-B, 34 IPC and summoning order dated 18.10.2024 (Annexure P-21) and all the
