Seeking initiation of criminal proceedings and register a case against the respondent for making false statement in pleading to the extent that respondent is the sleeping partner of the firm in question in case bearing number CRM-M-58171-2022 titled as Surender vs. State of Haryana and another, petitioner has come up before this Court by filing the present petition under Section 379 r/w 215 BNSS 2023. 2.

Petitioner's counsel draw attention of this Court to Annexure P-4 and alleged that stand taken by the respondent was contrary to the contents of partnership deed. 3.

However perusal of Annexure P-4 reveals that it is a photocopy of the partnership deed and nothing had stopped the petitioner to attach the certified copy of the said partnership deed or attested copy. This Court cannot draw inference from a photocopy of a document.

At this stage, petitioner's counsel seeks permission to withdraw the present petition with liberty to file a fresh with better particulars after annexing certified copy of the partnership deed.

Given above, petition is disposed of with liberty as prayed for. Pending applications, if any, stand disposed of.
